Stage One: Solicitor Instructed
This is the date the client accepts our quotation and gives us firm instructions to act.
Stage Two: Date deeds Requested
This is the date we write to the sellers solicitor to request the title documents and contract for the clients consideration.
Stage Three: Date deeds Received
This is the date we receive the Title Deeds from the sellers solicitor.
Solicitor:
- Inspects the title documents and raises any queries arising therefrom.
- Will produce a report on title to the client after their inspection of the documents.
- Arranges for the client to sign the contract.
Stage Four: mortgage offer Received
This is the date that we receive the mortgage offer from the client's new lender.
Solicitor:
- Receives mortgage offer
- Arranges for the client to sign the mortgage deeds and requests deposit
(or uses deposit from sale - if any) - Requests EJO and Bankruptcy search against the client
Stage Five: contract Stage
If all searches and property
certificates (i.e. Local Council, DOE, Statutory Charges Search, Title
Search, EJO and Bankruptcy searches, Replies to pre-contract enquiries)
have been received from the vendors solicitor and are clear, and all
queries raised have been answered the solicitor will send the contract
to the vendors solicitor for signature by their client. The
solicitor will usually ensure that the matter is in a position to
complete by requesting funds from the lender and the client at this
stage if we have not already done so.
Solicitor:
- Prepares draft deed to be sent with the contract for signature by the vendor
- Sends hrecontract to seller's solicitor
- requests mortgage monies from the lender if not already done.
- Prepares final accounts and requests any monies required from you.
Stage Six: Case Completed
This is the date the purchase
completes and our client gets the key of the property to move in.
We will pay the stamp duty on this date and await the signed deed from
the seller pending registration.
Solicitor:
- confirms that completion has been effected and when the keys are available to be collected by the client
- Sends balance purchase monies to sellers solicitor to be with them on the morning of the completion date
Subsequent to completion day the solicitor:
- Registers client ownership at land registry
- Sends deeds to Bank or Building Society (if any) upon completion of all matters of registration
